In one of the most light-hearted moments shared between them, a broad smile crossed Jean-Pierre's face as she laughed out loud at the unexpected question. I’m going to be very careful from here, as you know, because we are covered by the Hatch Act and I’m not going to speak further to this process.” According to the Justice Department, the Hatch Act forbids federal "employees from engaging in partisan political activity while on duty, in a federal facility or using federal property."
Doocy then asked, “Is there a precedent for people running for president after FBI agents search their sock drawer?” The question was likely intended to be provocative and draw attention to the recent search of President Biden's residence. Jean-Pierre did not respond to that question.
Doocy's next question was more direct: "The House Oversight Committee chairman says this document situation has all the characteristics of a potential coverup. Is President Biden involved in a coverup?" Jean-Pierre replied, "We've been very clear here from this administration, the President has been very clear that, um, he takes this very seriously, when it comes to classified information. … And that his team has been fully cooperative," before directing Doocy to the White House counsel for more information. The question about a potential coverup was a serious accusation that Jean-Pierre had to address.
The press secretary was put in a difficult position, having to balance the need to provide information and answer questions while also being mindful of the legal restrictions placed on her by the Hatch Act.
