White House press secretary Karine Jean-Pierre responded firmly to Fox News White House correspondent Peter Doocy's questions about President Joe Biden's stance on the border wall.
The Biden administration has allowed exceptions to 26 federal laws in South Texas to facilitate the construction of additional border walls in the state's Rio Grande Valley sector. Border officials reported encounters with over 245,000 migrants attempting unauthorized entry into the U.S. in fiscal year 2023, as stated in a document from the Department of Homeland Security (DHS).
“As a candidate, President Biden didn’t say ‘There will not be another foot of wall constructed, except for what was appropriated in 2019.’ He said, ‘There will not be another foot of wall constructed in my administration.’ So, something changed. What?” Doocy asked.
“You want us to break the law,” Jean-Pierre said. “Is that what you want? You want us to not comply with the law.”
“I’m not — I’m asking about, he was —” Doocy began.
“But you want us not to comply with the law,” the press secretary said. “You want us not be an administrations [sic] that follows the rule of law.”
“You guys do this all the time. The student loans, the student loan forgiveness program. You went to court to fight for that. If this is such a problem, building 20 miles of wall, why not just go to court?” Doocy inquired.

The DHS made exceptions to several federal laws, such as the Clean Air Act, Safe Drinking Water Act, and Endangered Species Act, to allocate funds set aside by Congress since 2019 for the construction of the border wall, as reported by the Associated Press (AP). Amidst a unique situation, the administration decided to utilize the funds designated for the border wall construction, given a timeframe to either use or forgo the money.
The press secretary mentioned that Congress had rejected the administration's plea to redirect funds away from the border wall construction.
Doocy proceeded to ask if the administration would dismantle the wall, assuming they deemed it ineffective. The press secretary chose not to entertain "hypotheticals," emphasizing that the DHS is acting in accordance with the law.
While campaigning for the presidency, Biden consistently assured that his administration would not continue the incomplete wall initiated during the tenure of former President Donald Trump. In a conversation dated Aug. 5, 2020, Biden guaranteed that there would "not be another foot of wall constructed" on the southern frontier.
Upon taking office in January 2021, the Biden administration paused the wall's construction. Mark Brnovich, the Republican Attorney General of Arizona, filed a lawsuit against the administration in April due to this cessation, and 40 Republican senators alleged Biden was breaching federal law.
