California Governor Gavin Newsome Approves Broadest Gun Seizer Laws in United States

On Friday Democratic California Governor Gavin Newsom signed 15 different pieces of gun legislation into law, approving some of the strictest gun laws and gun seizure powers in the United States.

A "red flag" law has been reinforced by Newsom that enables educators, employers and co-workers to request a restraining order be placed on gun owners when they believe someone is a danger to themselves or anyone else, per the AP.

“California has outperformed the rest of the nation, because of our gun safety laws, in reducing the gun murder rate substantially compared to the national reduction,” Newsom said while approving the legislation. “No state does it as well or comprehensively as the state of California, and we still have a long way to go.”

Newsome also asked people in California to “tune in as we sign 15 bills … to help prevent gun violence in CA.”

The governor claimed that gun homicides declined twice and fast as the national average between 1993 and 2017.

Co-workers who want to have another employee’s guns seized must demonstrate that they have “substantial and regular interactions” with the gun owner they are fingering.  Employers must also agree with the employees assessment before a restraining order is issued and accusers must complete a sworn statement that explains why they believe the gun owner should be restrained.

The American Civil Liberties Union (ACLU) did not support the bill because the legislative watchdog believes it “poses a significant threat to civil liberties” as gun owners can be subject to a restraining order without even being told they are under investigation, AP noted.

Also, the ACLU argued that co-workers might not be the ideal person to judge a gun owner’s potential danger because they could well “lack the relationship or skills required to make an appropriate assessment.”

The new laws will be effective Jan. 1, 2020.
